mother died earlier and made a will:   brothers John & Philip, mother is dead, father is alive

November ye 10th 1678 This is affirmed to be ye last will of Willm: Kaighen who committed his soule to God, & his bodie to Christian buriall. Inprimis to ye poor pte of his clothes to be distributed by & at ye discretion of his son John. It: he left all ye rest of his cloathes unto his sone John, & on old fither bed which he said was all ye goods he had to bequeath & remaineing for his funerall charges that there was twentie one shills: wch was due unto him from Katrine Norris, whereof he left his two sonnes Jo: & Philip fifteen shills: If she would pay it willingly otherwise to prosecute for ye whole Item he said there was six shill: due from Jo: Cayne Ballonney. He constituted his said sonne Jo: & Philip Executors of the same Testes: Gilbert Moor X } Gilbert Kaighen X} jurati John Kaighen one of ye Execr: sworn in Court declares by vertue of his oath yt there is noe other goods but wt is included in the will to be Inventaryed [next page] At Jourby Church ye 27th of March 1679 John Kaighin one of ye Execrs: hath refused in Court to prove ye will or to collect the wthin debts --th--- for himself or brother who is now in Irland or to be sworn Execr: therfore ye Genrll: Sumner is take order imediatly to collect the same and return Inventary tehrof to ye Records, yt soe ye Church may pceed to give Administracon to whom by law it appertaines ordered yt ye Genrll: Sumnr doe forth wth repair to ye house of ye wth John Kaighen and take a pfect Inventary of all such goods as he dyed possest of and to charge the psons on whom the wthin debts are bequeathed to clear themselves in form of law or otherwise to pay the same for ye use of ye Execr: who at prsent is out of the country; the other Exec: haveing relin= quished his pt therof in court, & ye Genrll: Sumner or his deputy to be allowed a reasonable satisfaction for his pains therin, at the court discretion, & this is to be pformed forthwth sub paena juris P: Thompson John Christian Regrmus: Adi: The Genrll: Sumner or his Deputy to be put in execution, and to return this to ye Records wth an account of his pceedings therin
