October 29th 1674 In the name of God Amen, I Tho: Huddleston of Balleycott sicke in bodie but whole i minde of good and pfect memory praised be God doe make this my testament, in forme and manner ffollowinge, first, I comitt my soule to God my Creator and most mercifull Redeemer and to Jesus Christ my Savior and the Holy Ghost my Comforter hopeinge and proveing to enjoy eternall life and everlastinge joy through the merits of Jesus Christ, and I comitt my Corruptable bodie to X?ian buriall, Item I bequeathe to the poore 5 boules of meale either of barley or oat meale Item I bequeath to my sonn Tho: the maire I bought of James Ratcliffe, Item I bequeath to the child in the wombe yf it be a daughter fiftie pounds sterl: and if it be a son xx£[20£] sterl: to be paid when he or shee comes to xxj yeeres of age, Item I bequeath to my deere and lovinge wife all my whole estate lands houses milne and all the appurtenances to them belonginge till my son & heire be xxjtie yeeres of age and then she is to give him a full cropp of corne. Item I constitute and ordaine my deere and lovinge wife my sole and whole Executor of all my worldly goods whatsoever move= =able and unmoveable. Item if it be Gods will to call for the sayd child in the wombe then if it be a daughter the heiress to have his choyce either to have the sayd fiftie pounds or the Cropp and if he chuse the money then the Executor is to have the Croppe. Item I bequeath to Sr Tho: Parre a boule of mault and to preach my funerall sermon; further if God hath soe decreed to call for my wife before this three or foure yeeres then my will is that my brother Mr Jo: Barrey shall have the tuicon of my children and sett all my estate to the best for my children pfitt and advantage and to have five pounds a yeere for his owne paines and labour and then if it be a daughter that is in the wombe shee is to have one hundreth of pound portion and if a son to have fiftie pounds portion and the heire to be kept to schoole and then to the universitie and to be mantained out of the Estate dureinge all that tyme Moreover my will is that if it shall soe happen to call for my children and that the heireship shall discent to one of my brethren then I doe will and decree that my wife shall have, enjoy, and possess all my lands houses and milne wth all theire appurte= =nances till the Expiration of xxj yeeres from the death of Tho: my son and that for this cause that my said wife is to pay to my brethren and sisters the portion wch my father and mother left upon me to pay to them. 75: Jaine Callow enters 3s-8d & 100 of heringes between & for h---- ------[torn] [next page] Whereas there hath been lately a dispute and difference betwixt mee Jane Cannell als Huddlestone one of ye Executrs: of my deceased father and mother Mr William Hudlestone and Mrs Elizabeth Hudlestone of Ballacott and my sister in law Mrs Margrett Hudlestone als Leatherlan ye relict of my deare deceased brother Capt: Thomas Hudlestone, and that concerning ye filiall porcon or childs part of goods due to mee ye said Jane Cannell als Hudlestone by the death or decease of my sd father and mother as by their last will and testament may at large appeare as alsoe by ye decease of my two brothers George and Fferd: Hudlestone since ye death of my sd parents; All which goods or porcon remaining in ye custodye or keeping of my sd brother Capt Thomas Hudlestone at his death and now being come to a finall end and acompts all deductions substrac= =tions and reakening made betwixt us for all dues and demands I ye sd: Jane Cannell als Hudlestone doe find and hold myselfe to be well contented and satisfied that no more is due mee by ye death of my sd parents and brethren but ye summe of thirty nine pounds And I doe hereby bind myselfe my Executrs: Admrs: and assignes to receive embrace and accepts of thirty nine pounds (besides what I have already received) and to be well contented satisfyed and payd for and in leiu consideration and full payment for all dues and demands whatsoever that is made or that may or cann be made for my porcon or part of goods due by ye decease of my said brethren and by the testaments of my said parents or any other wayes whatsoever which summe of thirty nine= pounds soe thus accepted of an well satisfyed there with irrevocably is to be payd in manner and forme following that is to say ten pounds at ye signinge here of and wch I ye sd Jane doe acknowledge hereby to have received and ye other twenty nine pounds to be paid to mee or my Executrs administrs or assignes at or upon ye feast day of St John Baptist next ensueing being ye 24th of June which shall bee in ye year of our Lord God one thousand six hundred seventy and six.
